RESERVATION & PAYMENT

By making an ONLINE reservation/booking via the mergavicta.com web page booking system or OFFLINE, you are expected to pay the full amount at once for all the products. Once you go to checkout and click pay now, you will get a confirmation email. The payment via ONLINE reservation/booking system is done only with Credit Card (WSPay), if you desire to pay by Bank transfer, please contact us directly.

EXTREME WEATHER CONDITIONS

We reschedule the activity in case of extreme weather conditions, extraordinary circumstances, which could not have been foreseen or avoided, or have occurred immediately. The activity is than rescheduled for a day or two – prior or after the date booked. If the change is not possible, the payments will be refunded in full amount.

BOOKING PROCEDURE

A booking for a trip with mergavicta.com can be made by first checking price and availability and then sending booking form and a deposit. A deposit is 20% of the price of the total price. A booking is not confirmed before we receive the booking form and deposit at which point a receipt and invoice for the final balance will be issued. The balance is due four weeks before departure. Full payment is required for a booking made less than four weeks before departure. Payment can be accepted with bank transfer or online by credit card. If the balance is not paid at the specified time, unless previously arranged with us in writing, we reserve the right to cancel the booking

CANCELLATION BY US

We reserve the right to cancel the tour for reasons beyond our control. A full refund will be made but we accept no responsibility for further compensation. If such cancellation is due to ‘force majeure’ (inclusive of war, civil or political unrest and natural disasters) reasonable expenses we have incurred will be deductible from any refund. Any compensation and refund are strictly limited to monies paid to us. We are not liable for any expense you have incurred as a result of your booking.

CANCELLATION BY YOU

If the Client should cancel the booked tour, all Client’s cancellations must be in writing. By email. The written cancellation date shall be the basis for the compensation of cancellation costs. As per conditions set below (percentage of total arrangement price):

Cancellations made 8 days or more prior to the event date, will receive a 100% refund.

Cancellations made 2-7 days prior to the event date, will receive a 50% refund.

Cancellations made 1 day prior to the event date, will receive a 0% refund

COMPLAINTS

In the unlikely event of you being dissatisfied with any aspect of the trip, the matter should be raised with the leader/guide/your ground operator in the agency as soon as possible. Matters can usually be put right on the spot. Failure to do this will adversely affect any claim at a later date. In the event of continuing dissatisfaction, the complaint should be made to us, in writing, within 14 days of your return. We will investigate fully and report back to you as soon as possible. We agree to independent arbitration should this become necessary.

NOTICE ON FILING CUSTOMERS’ COMPLAINTS

Any complaints regarding the quality of our services must be submitted in writing to:

You will receive a response to your complaint in writing within 15 days of receipt of the complaint. Required information: name and surname of the person filing the complaint, the exact address for submission of responses.

COURT JURISDICTION

You have the right to judicial arbitration. The Client and the Trade will aim to settle possible lawsuits. Agreements not reached, become subject of the Korčula Court jurisdiction – under the authority of the laws of the Republic of Croatia.

All user data is strictly kept and is only available to employees who need this data to do the job. All employees of Black Island Winery d.o.o. and business partners are responsible for respecting the principles of privacy protection.”

Protection of personal data in accordance with the General Data Protection Regulation of the European Parliament and of the Council No. 2016/679-Regulation and the implementation of the General Data Protection Regulation

WSPay, as the executor of credit card authorization and collection, handles personal data as a processor and handles personal data in accordance with the General Data Protection Regulation of the European Parliament and the Council No. 2016/679 and the strict rules of the PCI DSS L1 regulation on protection of registration and data transmission.

WSPay uses SSL certification for 256-bit encryption and the TLS 1.2 cryptographic protocol as the highest levels of protection when writing and transferring data.

Personal data used for the purpose of authorization and collection, ie in the performance of obligations under the Agreement or under the Agreement, are considered confidential data.

The following personal data of the customer are required for the execution of the Contract (authorization and payment):

WSPay does not process or use this personal data except for the purpose of executing the authorization and collection agreement.


WSPay guarantees the fulfillment of all conditions set by the applicable regulations on personal data protection for personal data processors, and in particular the taking of all necessary technical, organizational and security measures, and this is especially confirmed by the PCI DSS L1 certificate.


mergavicta.com (retail store) uses WSPay for online payments.


WSPay is a secure system for online payment, real-time payment, credit and debit cards and other payment methods. WSPay provides the customer and merchant with secure registration and transfer of entered card data, which is confirmed by the PCI DSS certificate that WSPay has.
